Welcome to Shader-Market.lv (referred to as "we", "us", or "our"). These Terms and Conditions govern your purchase, download, and use of the "Magic Menu" Blender add-on (Basic and Premium versions) and any other digital content provided on our website.

By purchasing our products, you agree to be bound by these terms. These terms are designed in strict compliance with the consumer protection laws of the Republic of Latvia and the European Union (EU) regulations regarding e-commerce and digital content.

1. General Provisions

These Terms apply to all users and purchasers on our website. As a business operating out of Latvia, we adhere to the legal frameworks established by the Latvian Consumer Rights Protection Law (PTAC) and the EU Consumer Rights Directive (Directive 2011/83/EU).

2. Product Delivery and Download Limitations

Upon successful processing of your payment, you will receive immediate access to download your purchased digital files. To protect our digital intellectual property from unauthorized distribution and abuse, we enforce a strict download policy:

  • Download Limit: Your purchase grants you the ability to download the product file(s) a maximum of two (2) times from our website.

  • Additional Downloads: We understand that hardware fails and files get lost. However, if you exhaust your initial 2-download limit and require additional access, you must contact our customer support. Any request for further downloads will require further investigation into your account and purchase history to verify legitimacy before new download links can be manually granted.

3. Right of Withdrawal and Refund Policy

Because "Magic Menu" is a digital product delivered instantly, our refund policy differs from physical goods. We operate strictly within the legal exceptions provided by Latvian and EU consumer protection laws regarding digital content.

  • Refunds: Under EU law, consumers typically have a 14-day right of withdrawal (a "cooling-off period") for online purchases. However, there is a legal exception for digital content. By initiating the download of our add-on, you provide your prior express consent to begin the performance of the contract immediately. By doing so, you acknowledge and agree that you lose your 14-day right of withdrawal. Therefore, we do not offer refunds simply because you changed your mind, no longer need the product, or "just because."

  • Defective Products: If the digital product is fundamentally defective, severely bugged, or does not function as described on our sales page (specifically for the officially supported Blender versions 3.6 LTS through 5.0), you are entitled to a remedy. Under the Latvian Consumer Rights Protection Law, you may request that we fix the defect (via an update). If we cannot resolve the critical issue within a reasonable timeframe, you may be entitled to a partial or full refund.

4. License and Usage Rights

  • Personal and Commercial Use: You are permitted to use the "Magic Menu" add-on for both personal and commercial 3D projects.

  • Restrictions: You may not redistribute, resell, lease, license, sub-license, or share the add-on files, the Premium unlock passwords, or the source code with third parties. Doing so violates our copyright and will result in the immediate termination of your access and support.

5. Third-Party Services (Premium Version)

The Premium version of Magic Menu integrates with third-party Artificial Intelligence services (Google Gemini API).

  • We are not responsible for the uptime, continued availability, or any changes in the pricing/free-tier structure of the Google Gemini API.

  • You are responsible for generating, managing, and securing your own API keys in accordance with Google's terms of service.

6. Limitation of Liability

While we strive to ensure our add-on is safe and efficient, software can behave unpredictably. We are not liable for any loss of data, corrupted project files, missed deadlines, or consequential damages arising from the use of, or inability to use, the Magic Menu add-on. We highly recommend always saving your Blender files and maintaining backups before using complex destructive operations (like the Blend Objects or Orphan Purger Pro tools).

7. Dispute Resolution and Governing Law

  • Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Latvia.
